Terms of Service
These terms cover access to Thumb Pilot, player accounts, profiles, scores, leaderboards, marketplace features, virtual goods, and related services.
1. Eligibility
You must be old enough to use Thumb Pilot under the laws where you live, or have permission from a parent or guardian.
2. Accounts and Security
You may need an account to access features like player profiles, saved progress, leaderboards, marketplace activity, and other account-based features. You agree to provide accurate information, keep your login details secure, and take responsibility for activity on your account.
3. Player Names and User Content
Display names, pilot names, support messages, screenshots, feedback, and other content you submit must not be offensive, abusive, hateful, misleading, illegal, infringing, or impersonate another person or company. We may remove, edit, reset, or refuse user content at our discretion.
4. Fair Play and Service Integrity
You may not cheat, use bots, scripts, exploits, unauthorized automation, tamper with scores, attempt unauthorized access, reverse engineer the service, or otherwise interfere with Thumb Pilot or its systems. We may monitor gameplay, marketplace activity, and related data to protect fair play, service integrity, and security.
5. Scores, Profiles, and Service Records
We may review, correct, remove, hide, reset, reverse, or refuse scores, rankings, profile fields, marketplace listings, ownership records, or progression data if we believe they were affected by error, duplication, exploit use, abuse, fraud, moderation action, legal obligation, or account deletion.
6. Virtual Currency, Virtual Goods, and Marketplace
Buffalo Bucks, skins, aircraft variants, trophies, and other virtual goods are licensed, not sold, and remain part of the Thumb Pilot service. Except where law requires otherwise, they have no cash value, are not redeemable for money or property, and do not create any ownership right outside the service.
We may price, reprice, cap, modify, remove, suspend, relist, cancel, or reverse virtual goods, virtual currency balances, and marketplace activity at any time to operate the service, correct mistakes, enforce these terms, comply with law, or protect the in-game economy. Unless required by law, virtual-item and virtual-currency transactions are final and non-refundable.
If Buffalo Bucks, skins, or other virtual goods are offered for sale, those offers may vary by platform, storefront, territory, taxes, fees, exchange rates, availability, and promotional rules. Purchases may be processed by Apple, Google, a web payment provider, or another authorized payment platform, and may also be subject to that platform's separate terms, billing rules, parental controls, refunds, and purchase-restoration mechanics.
If a payment is reversed, refunded, charged back, canceled, declined, or found to be fraudulent or unauthorized, we may revoke or adjust the related Buffalo Bucks, skins, marketplace records, or account access to the extent reasonably necessary to correct the transaction and protect the service.
7. Service Changes and Availability
Thumb Pilot may change over time. We may update, rebalance, add, remove, suspend, or discontinue features, content, events, profiles, leaderboards, marketplace functions, or gameplay systems at any time without notice.
8. Ownership and Limited License
Thumb Pilot and all related code, art, music, sound, text, logos, branding, and other content are owned by us or our licensors and are protected by law. We give you a limited, revocable, non-exclusive, non-transferable right to use Thumb Pilot for personal, non-commercial entertainment, subject to these terms.
9. Entertainment Only
Thumb Pilot is entertainment software only. It must not be used for real-world flight planning, navigation, dispatch, safety, training, or operational decisions.
10. Suspension, Enforcement, and Termination
We may suspend, restrict, or terminate your account or access if you break these terms, cheat, abuse the service, create security or legal risk, or if we are required to do so by law.
11. Account Deletion
You may request account deletion by contacting airwear@buffaloairways.com or by using any deletion tools we provide. Upon deletion, sign-in access, profile data, active identity, Buffalo Bucks, and owned virtual items may be removed, forfeited, canceled, repossessed, or relisted as described in our deletion flow or support materials. Some limited records may be kept where reasonably necessary for legal compliance, security, fraud prevention, dispute resolution, accounting, or enforcement of these terms.
12. Privacy
Your use of Thumb Pilot is also governed by our Privacy Policy.
13. No Warranties
Thumb Pilot is provided "as is" and "as available." We do not guarantee uninterrupted service, error-free operation, or that all bugs, exploits, or issues will be fixed.
14. Limitation of Liability
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of data, scores, progress, profits, virtual goods, or business opportunities arising from your use of Thumb Pilot.
15. Changes to These Terms
We may update these terms from time to time. By continuing to use Thumb Pilot after updated terms take effect, you agree to the revised terms.
16. Governing Law and Contact
These terms are governed by the laws of Northwest Territories, Canada, and disputes will be handled in the courts of Northwest Territories, Canada, unless the law requires otherwise. Questions can be sent to airwear@buffaloairways.com.
